ACCEPTANCE OF TERMS By accessing and using StreamWorks ("the Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service ("Terms") govern your access to and use of StreamWorks, a video hosting and streaming platform. By registering an account, uploading content, or using any of our services, you agree to comply with and be bound by these Terms. 2. USER CONDUCT AND PROHIBITED CONTENT You agree not to upload, post, transmit, or otherwise make available any content that: 3.1 Illegal Content - Violates any local, state, national, or international law or regulation - Infringes upon any copyright, trademark, patent, trade secret, or other intellectual property rights - Contains unauthorized copyrighted material, including but not limited to music, movies, TV shows, or software - Promotes illegal activities or provides instructions for illegal activities - Contains material that is defamatory, libelous, or slanderous 3.2 Harmful or Dangerous Content - Contains viruses, malware, trojans, or other harmful computer code - Is designed to damage, disable, or impair the functionality of any system - Contains instructions for creating weapons, explosives, or other dangerous materials - Promotes self-harm, suicide, or dangerous activities - Contains graphic violence, gore, or disturbing imagery 3.3 Offensive or Inappropriate Content - Contains hate speech, discrimination, or harassment based on race, religion, gender, sexual orientation, disability, or other protected characteristics - Contains sexually explicit material, pornography, or adult content - Contains nudity or sexual content involving minors - Is obscene, vulgar, or offensive - Promotes or glorifies violence, terrorism, or extremism - Contains graphic or disturbing content without appropriate warnings 3.4 Spam and Misleading Content - Is spam, unsolicited advertising, or promotional material - Contains false, misleading, or deceptive information - Is designed to phish, scam, or defraud users - Contains clickbait or misleading titles or descriptions - Promotes pyramid schemes, multi-level marketing, or other fraudulent business practices 3.5 Privacy and Personal Information - Contains personal information of others without their consent (including addresses, phone numbers, email addresses, or financial information) - Invades the privacy of others - Contains content that was recorded without consent (where consent is required by law) - Discloses confidential or proprietary information Violation Consequences: Violation of these content policies may result in immediate removal of content, suspension or termination of your account, and may be reported to law enforcement authorities when appropriate. 4. INTELLECTUAL PROPERTY RIGHTS 4.1 Your Content You retain ownership of any content you upload to StreamWorks. By uploading content, you grant StreamWorks a worldwide, non-exclusive, royalty-free license to store, reproduce, and display your content on the platform, create thumbnails and preview images, distribute and stream your content to users, and use your content for platform functionality and features. This license continues even if you stop using the platform, until you delete the content or your account is terminated. 4.2 Copyright Protection You represent and warrant that you own or have the necessary rights to all content you upload, your content does not infringe upon the rights of any third party, you have obtained all necessary permissions, licenses, and consents, and you will not upload content that violates copyright, trademark, or other intellectual property laws. 4.3 DMCA Compliance StreamWorks respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please contact us with a description of the copyrighted work, the location of the infringing material, your contact information, and statements of good faith belief and authorization. 5. ACCOUNT SUSPENSION AND TERMINATION We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms of Service, uploading prohibited content, engaging in fraudulent or illegal activities, harassing other users, attempting to gain unauthorized access, using automated systems without permission, or violating applicable laws. Upon termination, your right to use the platform will immediately cease, and we may delete your account and all associated content without prior notice. 6. PLATFORM AVAILABILITY AND MODIFICATIONS We strive to provide reliable service but do not guarantee that the platform will be available at all times, free from errors, or that your content will be permanently stored. We reserve the right to modify, suspend, or discontinue any part of the platform, update these Terms of Service, remove content that violates these Terms, and implement or remove features at any time. Continued use of the platform after changes to these Terms constitutes acceptance of the modified Terms. 7. By using the platform, you consent to the collection, use, and storage of your personal information, the use of cookies and tracking technologies, and data processing for platform functionality and improvement. We implement reasonable security measures to protect your information, but cannot guarantee absolute security. 9. DISCLAIMERS AND LIMITATION OF LIABILITY THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Your sole remedy for dissatisfaction with the platform is to stop using it. 10. INDEMNIFICATION You agree to indemnify, defend, and hold harmless StreamWorks, its operators, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the platform, content you upload, your violation of these Terms of Service, your violation of any rights of another party, or your violation of any applicable laws or regulations. 11. DISPUTE RESOLUTION Any disputes arising from or relating to these Terms or your use of the platform shall be resolved through good faith negotiation between the parties, and if negotiation fails, through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class-action lawsuit or class-wide arbitration. 12.
